The former couple has asked that their trial be taken off the court's calendar in documents obtained by PEOPLE

Joshua Jackson and Jodie Turner-Smith have called off a trial over their custody arrangement for their 5-year-old daughter Juno.

According to court documents obtained by PEOPLE, the Tron: Ares actress' lawyer filed on Tuesday, Oct. 14, to ask that the former couple's divorce trial, which was scheduled to begin on Wednesday, Oct. 15, be taken off the court's calendar.

The documents show that Turner-Smith, 39, is working with Jackson, 47, outside of the courtroom to find a custody deal for their daughter.

"[Turner-Smith and Jackson] are in the process of negotiating a custody judgment. The parties will return to the privately compensated temporary judge to resolve any impasses in the proposed custody judgment," read the documents.

Reps for Jackson and Turner-Smith did not immediately respond to PEOPLE's request for comment.

Since filing for divorce in 2023, Turner-Smith and Jackson have been going back and forth on their custody agreement for Juno. Most recently, this past June, the Doctor Odyssey actor filed an emergency motion alleging that his ex-wife changed their daughter Juno's school without his permission.

In his declaration, Jackson claimed that Turner-Smith asserted it's "no big deal to force Juno to start over with a new school" and that he's concerned that "Jodie is attempting to create a scenario where Juno travels with her rather than attending a traditional school."

At the time, Jackson requested that the court order Juno to keep attending the school she's been going to for the next academic year and asked for joint consent with Turner-Smith for any subsequent school changes.

After four years of marriage, Turner-Smith filed for divorce in October 2023. At the time, the pair agreed to joint custody of their daughter. They settled their divorce in May 2025, agreeing that Jackson would pay $2,787 in monthly child support.

However, the two were unable to agree on where Juno would go to school. In court documents obtained by PEOPLE, Turner-Smith stated that after she and Jackson entered into a "stipulation and order to resolve the issue of selection of Juno's school" in 2024, she had been granted the authority to "make the final decision" about her education — but she would initially have to consult Jackson on the matter.

Turner-Smith previously claimed in court documents filed in December 2024 in Los Angeles County Superior Court, and obtained by PEOPLE at the time, that Jackson had not paid child support for their daughter since October 2023.

In October 2024, Turner-Smith opened up about co-parenting with Jackson in her GLAMOUR Woman of the Year cover story, explaining that things can get "complicated."

"It's an adjustment period for anyone when they split up with someone because you're used to being with your child all the time," she said. "But nobody hands you a manual. Everyone's trying to figure it out."

Turner-Smith added, "Each parent has a different life, and especially if the reason why you're splitting up is because you have different lives, it's only further complicated by how you're going to coparent."
